When dealing with a debt collector, it is best to know your rights under the Fair Debt Collection Practices Act. You can find a link to the law HERE. The FDCPA is a federal statute that protects consumers in all 50 states. To qualify for protection, you must be a “consumer” within the definition of the FDCPA, and the debt at issue must arise out of a “consumer transaction” within the definition of the FDCPA.
If you qualify, the FDCPA protects consumers from unfair, harassing, and misleading debt collection tactics. The FDCPA allows a consumer to collect a penalty of up to $1000 if he or she defeats the debt collector in court. The FDCPA also allows the victorious consumer to collect attorneys’ fees from the debt collector.
